CLEVELAND FEDERAL COURT, OH (WOIO) - A federal judge ruled Cuyahoga County Common Pleas Court Judge Bridget McCafferty is allowed to stand trial by herself.

McCafferty faces one federal charge of making five false statements to law enforcement.

The statements were regarding conversations with Cuyahoga County Commissioner Jimmy Dimora and former Auditor Frank Russo.

McCafferty had been scheduled to stand trial with Dimora, but her attorney argued that would not be fair and the judge agreed.

McCafferty's trial is set for February 22nd, 2011.

She remains suspended from the bench - with pay - and a retired judge has been handling her cases.
