UPDATE: CLEVELAND, OH (WOIO) - The owner of the boat that 20-year-old Emma Nahas disappeared from, and eventually drowned in Lake Erie, was in court on Tuesday morning.

Prosecutors say Alex Cucu bought Emma and several other underage girls booze and took them boating on Lake Erie. Emma jumped into Lake Erie and drowned last July.

Cucu faces ten criminal charges that includes getting the underage girls drunk.

The Coast Guard is now changing previous statements made to 19 Action News. Previously, they told Reporter Scott Taylor they had fined Cucu $5,000 for boating under the influence. He had 30 days to appeal.

Now, they say they have told Cucu, based on the evidence, they intend to fine him $5,000 for boating under the influence.

Cucu has filed a response and a Coast Guard hearing officer will make a final determination.

Cucu is due back in court next month.
