Cuyahoga County prosecutors say a woman has been indicted in the deadly hit & run of 13-year-old Charlie Kho. 

Helen Fettes, 80, indicted on one count of vehicular homicide, one count of failure to stop after an accident, and one count of tampering with evidence.

The indictment says on October 17, 2011, Fettes, 80, of Olmsted Falls, struck 13-year-old Charles Kho with her vehicle in the area of Cook Road in Olmsted Township around 7:00 pm.

The victim was flown to MetroHealth Medical Center.

He died the next day.

"There was no regard to him at all and when she left and tried to cover it up. I don't care if you're 16 or 90, it doesn't matter," said Cassandra Moscalink.

Police were tipped off to the car involved in the hit and run after the car was brought into a dealership for repair.

The receptionist knew something was not quite right, and contacted police.

"To find out why, I'm sure that's a question we all have. Why? What was the reason for distraction, I mean what was it?, said Ally Hali-Kho.

"It's still seems unreal that my brother is gone, but things happen for a reason in this world and there's nothing you can do to change it. I'm just glad there's justice," said Callie Kho.

Fettes faces a maximum of 10 ½ years in prison.
