Attorney arrested, charged with lack of physical control in Copley

COPLEY, OH (WOIO) -

An attorney arrested and charged with lack of physical control by police in Copley.

It happened around 1:30AM on February 5th.

Officer Thomas Ballinger was on patrol when he noticed a vehicle parked in the parking lot of Ridgewood Crossing Drive with the headlights on and engine running.

The officer stopped to investigate, and could smell alcohol coming from the vehicle.

Two women were in the vehicle - Attorney Catherine Loya and Judge Joy Oldfield.

Loya refused a field sobriety test and was taken to the police station to provide a breath sample. She refused that too, and was cited for lack of physical control.

After being cited, Loya and the judge were transported by police to Loya's house.

The judge was not charged.

Judge Joy Oldfield's attorney, John Hill, has now made allegations about Officer Ballinger's honesty.

Police say Officer Ballinger, out of respect for the judge and because she was not charged, did not list her name in the standard police report, which is public record.

However, now that the judge's attorney made a complaint, police have started an investigation into her role in the incident.
