CLEVELAND, OH (WOIO) -
The North Ridgeville man accused of bringing a backpack full of weapons into the Crocker Park movie theatre earlier this month went before a judge Thursday morning.
Scott A. Smith faces 21 counts, including carrying a concealed weapon and having weapons under disability.
The 37-year-old married father came to the courtroom of Judge Kathleen Sutula for the first time. He had earlier won a bond reduction to $100,000. His wife posted that a week ago, but due to the nature of the crime, it wasn't so simple for him to be released on house arrest.
Smith was arrested on August 4 while seated in a showing of the movie Dark Knight Rises.
An off-duty officer and movie theater manager confronted Smith because he was acting suspicious. Smith opened his backpack without a fight, and revealed a Glock 9mm handgun and three knives. Smith does not have a concealed carry permit.
Police say Smith was seated in the last row of the theater with his back against the wall. That's what police call a tactical position.
Attorney Matthew Bruce, who represents Smith, said his client, who peacefully surrendered to police, had no plans of harming anyone. He said Smith's weapons were for his protection only.
A search warrant was executed at Smith's home, and officers found more weapons, a gas mask, tactical vest and more ammunition.
On Thursday, Judge Sutula outlined exactly what being on restriction and a GPS device meant. Where he can - and can't - go.
"You will be restricted from going to the Crocker Park area, specifically the movie theater and Crocker Park Promenade. Do you understand that?" the judge asked Smith.
"Yes, your honor," he replied.
Smith can't leave his home without prior permission, he is undergoing court psychological testing and is under the supervision of the probation department, which will monitor his every move.
