Life in prison for man convicted of murdering teacher

CLEVELAND, OH (WOIO) -

The man convicted of killing a Cleveland school teacher in 2008 was sentenced to life in prison without the possibility of parole for 33 years.

Judge David Matia sentenced 24-year-old Richard Penque to prison on Tuesday morning.

On April 7, 2008, 54-year-old Marilyn Habian was found shot to death in the basement of her home on Ball Avenue in Euclid.  Habian died of a single gunshot wound to the chest.

Penque was a neighbor who lived across the street from Habian.  Penque killed Habian then put combustibles on top of the stove which started a fire in her home.

The Euclid Police Department solved this cold case. Penque was subsequently indicted on September 30, 2011, the day before he was scheduled to be released from prison for an assault in Chesterland, Ohio in 2009.

On October 12, a jury found Penque guilty of one count of Aggravated Murder, two counts of Aggravated Burglary, one count of Kidnapping, one count of Attempted Aggravated Arson and one count of Tampering with Evidence with firearm specifications.
