The driver involved in an accident that killed Willoughby police officer Jason Gresko has been indicted.

According to the Lake County Prosecutor's Officer, Scott Leland has been indicted on aggravated vehicular homicide, driving under the influence and endangering children.

Leland was arraigned Wednesday morning, and was formally charged. He was able to post bond, and was released on personal recognizance with restrictions. He is not to drive or consume alcohol.

Officer Gresko was killed in the line of duty on September 21 when his cruiser collided with a pick-up truck while he was responding to an emergency call. Leland had a BAC of .14.

The cruiser video shows Officer Gresko was responding to the call for assistance and traveling northbound on Harmony Lane. Officer Gresko activated his emergency lights as he slowed down for a stop sign at the Jack Reinhardt Avenue intersection. Officer Gresko continued northbound on Harmony Lane with his emergency lights activated.

As Officer Gresko approached the 5170 block of Harmony Lane, a slow moving 2011 Chevrolet pick-up truck that appeared to be yielding to the patrol car turned left in front of Officer Gresko.

Officer Gresko attempted to avoid the truck going off the right side of the road and colliding with a tree. A witness driving southbound behind the truck observed the emergency lights and pulled to the curb and stopped.

Leland's truck had four occupants, two adults and two thirteen-year-olds. They were not hurt.

Leland's next court date has yet to be set.

Gresko is survived by his wife and young daughter.
