Garda employees sue company for lack of overtime pay

TALLMADGE, OH (WOIO) -

Former drivers accuse "Garda" of not paying for over time.

Two of it's armored truck drivers say they are being taken for a ride when it comes to over time.

The drivers who drove armored trucks for Garda in Tallmadge and in Michigan say Garda didn't pay them for their first ten hours of overtime.

Their attorney with 1-800-Law-Firm says that violates labor laws. 

Attorney Ari Kresch says "Garda is writing it's own laws.  Garda says if you work for us we will pay you overtime after 50 hours.  the only problem is State and Federal Law says overtime gets paid after 40 hours."

1-800-Law-Firm just filed a class action lawsuit against Garda.  It says Garda failed to pay overtime for a driver's first ten hours of overtime worked in a week.

The plaintiffs say this is a Company wide policy. 

Kresch adds "It's a situation many employers are taking advantage of because employees feel powerless.  The are afraid to step forward."

Our Scott Taylor dropped by Garda in Tallmadge for some answers.

He asked an employee who answered the door "Do you know if you guys don't pay time and half for the first ten hours of overtime?"

She said "I don't have any clue on how they do overtime."

The drivers are asking for back wages, damages and an injunction to stop any such overtime policy that may exist at Garda.

Kresch says "They are saving the overtime pay for well over a thousand employees."

Garda's official statement "We do not comment on pending litigation."
