Garfield Heights cold case sentence, no extra time for convicted rapist

CLEVELAND, OH (WOIO) -

A man who pled guilty to the 1990 rape of a stranger at a shopping center in Garfield Heights  won't get any meaningful punishment because a statute of limitations.

Timothy Byrne was sentenced to 15 years as part of his plea deal but he's already doing 17 years in Tennessee for the rape of a child and his new sentence will run concurrent, or at the same time, as the other one.

This means Timothy will not do any extra jail time for the Garfield Heights rape.

Prosecutors say Byrne raped a woman in 1990.

DNA was entered into a database in 2007 and in 2012 police got a hit on a match for Timothy Byrne. But the statute of limitations for rape is 20 years.

Investigators are disappointed that they couldn't get any actual punishment for the Garfield Heights cold case.
