Assault charges dismissed, but Cleveland City Council candidate not in the clear

CLEVELAND, OH (WOIO) -

19 Action News Reporter Ed Gallek has learned that assault charges have been dismissed against Cleveland City Council hopeful Janet Garcia, but the candidate is not entirely in the clear.

The case was scheduled to go to trial on Monday.

Records show Garcia interfered when Westlake Police tried to arrest a drunk friend. Garcia said she considers herself a victim of racism.

"I came to the aid of someone in my community that needed my assistance," Garcia said. "I didn't assault an officer."

Gallek has learned that prosecutors do plan to re-indict Garcia. They dismissed the case because key witness were out of town.
