CLEVELAND, OH (WOIO) -

New charges have been filed against Cleveland City Council candidate Janet Garcia.

A grand jury has re-indicted her on a felony assault charge and a misdemeanor assault charge.

Earlier charges were dropped on the day of trial since a key prosecution witness was unavailable. So Cuyahoga County prosecutors have had Garcia indicted once again on the same charges.

It all stems from an arrest by Westlake Police. They say Garcia interfered with someone else from a group of friends getting arrested for being disorderly.

Police say Garcia hit an officer with a purse and more. She has said she was a victim of racial profiling.

"I was ready for trial then, and I am ready for trial...I plan to fight these charges and clear my name again," says Garcia.

Garcia also has made headlines since former hostage Gina DeJesus made her first public appearance wearing a Garcia campaign t-shirt and riding in Garcia's campaign car during the recent Puerto Rican festival downtown.

Garcia's been accused of taking advantage of Gina DeJesus, but the DeJesus family calls Garcia a close friend.
