CLEVELAND, OH (WOIO) -

A Cuyahoga County Common Pleas Court jury convicted a drunk driver Monday afternoon.

Charles Dukes was found guilty of aggravated vehicular homicide, a third-degree felony, and driving under the influence, a first-degree misdemeanor.

Judge Deena Calabrese set sentencing for Feb. 13.

On January 4, 2013, Dukes, 60, of Cleveland, drove intoxicated in the area of East 155th Street and Harvard Avenue in Cleveland, and struck a vehicle driven by the 70-year-old victim, Thomas M. Thomas, killing him.

Dukes was operating his vehicle without his front headlights on and was driving in excess of the posted speed limit.
