Guards on trial after letting gun go though security checkpoint

CLEVELAND, OH (WOIO) -

Trial is underway for the two Justice Center guards facing criminal charges for not catching a gun in a purse that went through the x-ray machine.

"They are not doing their job. Look at the video. Recklessly failed to do their duty," said Victor Perez, Prosecutors office.

Debra Black and Rose Kresty are charged with dereliction of duty.

The surveillance video shows Black turning away from the x-ray screen and having a snack. Kresty is checking her phone, but checks the x-ray screen and doesn't notice anything.

The gun was eventually found at another checkpoint on the sixth floor.

Late Wednesday afternoon, the defense team asked for the charges to be dismissed.

Judge Pinkey Carr will make her decision next week.

Criminal charges has since been dropped against the woman who brought the gun to the Justice Center.
