Lawsuit filed after school bus driver hit young student

CUYAHOGA FALLS, OH (WOIO) -

A lawsuit has been filed against the Cuyahoga Falls School District over an accident involving a bus driver and a third grader.

The suit says driver Dave Nickles hit the child one morning last year, and he took the child to school instead of waiting for police or getting the child medical attention.

Attorneys Dan Margolis and Michael Brennan argue the driver was instructed by supervisors to simply take the child to school. And they question whether Nickles should have even been driving a bus due to other driving incidents.

The school superintendent tells 19 Action News that Nickles has turned in a letter of resignation effective Monday.

The superintendent says he cannot discuss other details since the matter is in the hands of lawyers with the district's insurance company.
